TURKPATENT released Turkish industrial property statistics of 2021


Turkish Patent and Trademark Office (TURKPATENT) has released statistics of 2021. A total number of 248,597 domestic industrial property applications were filed in 2021, including 8,439 patent applications, 4,418 utility model applications, 176,493 trademark applications and 59,247 design applications.

Compared to the previous year 2020, it has been observed that there was an increase of 3 percent in domestic patent applications, 24 percent in domestic utility model applications, 13 percent in domestic trademark applications and 41 percent in domestic design applications.

When domestic and foreign applications are combined, while the total number of domestic and foreign filings increased by 24 percent for utility models, 12 percent for trademarks and 39 percent for designs, the number of patents decreased.

19 universities took place among the first 50 entities to apply for domestic patents in 2021. 11% of domestic patent applications were filed by universities.

The sectors with the highest number of domestic patent applications in 2021 were respectively followings:
  • Medical and surgical equipment and orthopedic vehicles (609 patent applications)
  • Office machinery and computers' (534 patent applications)
  • Household appliances (523 patent applications)
  • Motor land vehicles trailer and semi-trailer (483 patent applications)
  • Pharmaceutical products, medicinal chemicals and botanical products (469 patent applications).
352 geographical indications were registered in 2021. Thus, the total number of registered geographical indications increased to 990 in Turkey. The provinces with the highest number of geographical indication applications in 2021 were Erzurum with 61 applications, Van with 34 applications and Gaziantep with 28 applications. Turkey has 7 geographical indications registered with the European Union. These are "Antep baklavası (Antep baklava)", "Aydın inciri (Aydın fig)", "Aydın kestanesi (Aydın chestnut)", "Bayramiç Beyazı", "Malatya kayısısı (Malatya apricot)", "Milas zeytinyağı (Milas olive oil)" and "Taşköprü sarımsağı (Taşköprü garlic)".

Turkey ranked 14th in the world in patent applications, 7th in trademark applications, 4th in design applications, and 9th in general industrial property filings at the national level.

Turkey has maintained its position as the country with the highest number of trademark applications in Europe since 2011. On the other hand, TURKPATENT became among the top 10 institutions that issued the most international search reports (ISR) for PCT applications last year.

Turkish PTO announced new official fees effective January 01, 2022


Turkish Patent and Trademark Office (TURKPATENT) announced new official fees for patents, utility models, trademarks and designs effective January 01, 2022.


The official fees for patents, utility models, trademarks and designs have been increased at a rate of average 36%.


Exceptionally, the official fees related to the provisional protection of European patent applications (publishing the Turkish translation of the claims), validation of European patents and PCT national phase entries in Turkey have been substantially increased at an average rate of 50% as follows:


  • Official filing fee for the provisional protection of the European patent applications in Turkey increased to 2.895 TRY from 1.930 TRY,
  • Official filing fee for the European patent validations in Turkey increased to 4.640 TRY from 3.095 TRY,
  • Official filing fee for the PCT national phase entries in Turkey increased to 3.020 TRY from 2.015 TRY.

TURKPATENT has, for the first time, differentiated the national phase entry fees according to the request of protection type, i.e. national phase entry as a patent application or utility model application. According to the new practice, the PCT national phase entry fee as a utility model application in Turkey amounts to 2.250 TRY, while the PCT national phase entry fee as a patent application in Turkey amounts to 3.020 TRY.


The other frequently paid fees have become as follows:


  • Official filing fee for a patent application: 75 TRY.
  • Official filing fee for a utility model application: 75 TRY.
  • Official filing fee for a trademark application: 380 TRY for one class and 380 TRY for each additional class.
  • Official filing fee for a design application: 270 TRY for one design and 120 TRY for each additional design.

The high fee increases have been due to the significant value loss of Turkish lira against major foreign currencies and high inflation during 2021. While the fee increase rates appear high, the official fees have remained lower in terms of major foreign currencies compared to the earlier year.

The official fees in the Turkish jurisdiction are revised and announced at the beginning of every year and come into force as from January 01 of each year. The schedule of fees announced for 2022 can be found on this link.


TURKPATENT accepts all the applications and requests, and the payments thereof via its electronic filing system (EPATS).

TURKPATENT takes measures to protect the personal data


Turkish Patent and Trademark Office (TURKPATENT) has taken some measures to protect the personal data under the Law No. 6608 for the protection of the personal data.

The measures cover important restrictions for preventing the revelation of personal data on online patent, trademark and design search and registry tools and in the official gazettes for patents, trademarks, and designs.

With the new measures being introduced, the below-listed personal data will not be disclosed in the online search tools and the official gazettes:

  • addresses of inventors or designers,
  • addresses of applicants and rights owners being natural persons,
  • email addresses of inventors or designers,
  • phone numbers of inventors or designers

The measures also cover the personal data of Turkish patent and trademark agents being natural person. Turkish patent and trademark agents will have the freedom of choice which of their personal data can be displayed or listed in the online search and registry tools, and the list of the patent and trademark agents provided by TURKPATENT.

While the personal data is no longer provided on the online search and registry tools and the official gazettes, the third parties will be able to obtain the contact details of the applicants/rights owners by filing a special request at TURKPATENT where such data is necessary for the purposes of court actions, mediation or license etc. In this case, the third parties demanding the contact details will have to electronically sign a statement of liability for use of the related data and such data will be sent by e-mail upon their signing such statement.

The data of the legal entities will remain available to the public as usual after their patent, trademark or design applications being published.

TURKPATENT amended its procedure for change of name, address and company type


Turkish Patent and Trademark Office (TURKPATENT) has made some procedural changes for recording changes of names, kinds and addresses of applicants and right holders as well as assigning customer numbers.

In the new procedure, TURKPATENT will no longer request the addresses of local persons (natural or legal) when filing applications as they will be automatically fetched from the Central Registry Number System (MERSİS), Turkish registry system of legal entities. Accordingly, the practice for change of address for local persons has been terminated.

In addition, TURKPATENT will no longer request any evidence for changing the names of the local persons as it will use the MERSIS database to confirm the change of name. In this regard, a simple request will be sufficient to record change of name for local persons. However, it will be necessary to submit evidence for recording change of names and company types of foreign entities.

Meanwehile, TURKPATENT will no longer assign a customer number for local natural or legal persons, instead using the Turkish Identification Number (T.C. Kimlik Numarası) for local natural persons and the tax number for local legal entities to identify them. On the other hand, TURKPATENT will continue assigning a number for foreign natural and legal persons, which is hereafter named "Person Number" (earlier called "Customer Number").

These procedural changes are especially important for local persons’ business, because they will any longer need to submit less information for IP filings and no documents for recording any changes. These changes will also allow TURKPATENT to keep consistent and up-to-date records regarding the right holders and fast process any changes when requested

TÜRKPATENT releases data for 2020 for industrial property filings

TURKPATENT

Turkish Patent and Trademark Office (TÜRKPATENT) announced the industrial property application statistics for 2020.

In 2020, it was noted that there was an increase of 0.7% in domestic patent applications, 23.2% in domestic utility model applications, 30.57% in domestic trademark applications, and 16.64% in domestic design applications compared to the previous year.

Patents


A total number of 7893 patent applications were filed in 2020, 7803 of which were filed by local entities and 90 of which were filed by foreign entities. A decrease of 0.2% was observed in the total number of applications compared to the previous year.

However, only considering the patent applications of local entities, it has been observed that there was an increase of approximately 0.7% in domestic patent applications (7751 in 2019, 7803 in 2020).A total number of 265 international patent applications entered the national phase in Turkey. This represents a decrease of 3.3% compared to the previous year (2019: 274).

A total number of 11828 European patents were validated in Turkey in 2020. This represents 8,8% decrease compared to the previous year (2019: 11828, 2020: 10785). While 10785 of total European patent validations were of foreign origin, 280 of them were of domestic origin.

Utility models


3600 utility model applications were filed in 2020 in Turkey, 3563 of which were filed by local entities and 37 of which were filed by foreign entities.

The total number of utility model applications increased by 22.4% compared to the previous year. Considering the domestic applications only, it was seen that there was an increase of 23.2% in the domestic utility model applications (2892 in 2019, 3563 in 2020).

Trademarks


A total number of 170590 trademark applications were filed in 2020 in Turkey. This represents an increase of 26.97% compared to the previous year. Among the total number of applications, the number of domestic applications was 155913.

The number of domestic applications increased by 30.57% compared to the previous year (2019: 119412).Total 14677 trademark applications of foreign origin were filed in Turkey. 

While 4562 of the trademark applications of foreign origin were filed directly, 10115 of them were filed through the Madrid Protocol. Accordingly, there was a 1.77% decrease in trademark applications of foreign origin compared to the previous year.

Designs


Total 11307 design applications were filed in 2020 in Turkey. Of these design applications, 9948 were of domestic origin, 365 were of foreign origin, and 993 were from The Hague system.

The number of domestic applications increased by 16.64% compared to the previous period.

TURKPATENT announced fee changes effective January 01, 2021

Turkish Patent and Trademark Office (TURKPATENT) announced new official fees for patents, utility models, trademarks and designs effective January 01, 2021. The fees schedule was published in the Official Gazette on December 30, 2020. 

The official fees for patent, utility models, trademarks and designs have been increased an average 13% for each fee. 

Exceptionally, the official fees related to the provisional protection of European patents, validation of European patents and PCT national phase entries in Turkey have been substantially increased at an average rate of 40%, specifically 1.930 TRY from 1.380 TRY for the provisional protection of the European patents, 3.095 TRY from 2.210 TRY for the validations of the European patents, and 2.015 TRY from 1.440 TRY for the PCT national phase entries respectively.

The other frequently paid fees have become as follows: 
  • Filing patent application: 55 TRY
  • Filing utility model application: 55 TRY
  • Filing trademark application: 280 TRY per class
  • Filing design application: 200 TRY for one design and 80 TRY for each additional design 
The official fees in the Turkish jurisdiction are revised and announced in the beginning of every year and come into force as from January 01 of each year.

Data transfer feature between TURKPATENT and EPO for European patent validations put into use


Turkish Patent and Trademark Office (TURKPATENT) has announced that a web service was created between European Patent Office (EPO) and TURKPATENT for the entries of the validation of the European patents and submission of the set of the claims for provisional protections in Turkey.

With the databases being integrated, when the users enter the grant number (B1) for validating the European patents in Turkey or the publication number (A1) for submitting the set of claims for European patent applications into the the EPATS, which is the electronic filing system of TURKPATENT, the following data will be automatically fetched from the database of the European patent register:

  • European Patent Application Data
  • European Patent Application Number
  • European Patent Application Publication Date
  • European Patent Grant Date
  • International Patent Classes (IPC)
  • Priority Claim Rights Data
  • Title and Address of Applicants and Holders
  • Title and Address of the inventors

This new facility will substantially accelerate the filing procedure and provide the consistency of the data between both Offices.

Physical filing route for industrial property rights closed in Turkey


Turkish Patent and Trademark Office (TURKPATENT) has recently announced it will close physical filing route for the industrial property rights (patents, trademarks, designs etc.). Accordingly, it will not be possible to physically (non-electronically) file the applications and post-filing demands as from January 01, 2020.

It will be mandatory to file all the applications and demands through EPATS which is the newly introduced web-based electronic filing system of TURKPATENT. The applicants and the patent and trademark attorneys will enter the EPATS via their passwords of e-Government or other methods such as mobile signature, electronic signature, internet banking.

TURKPATENT has issued this decision pursuant to Article 160 of the Turkish Industrial Property Law (Law No. 6769) after completing the technical requirements for the electronic filing system.

EPATS - New patent application system in Turkey


Turkish Patent and Trademark Office (TURKPATENT) has introduced new online patent application system (EPATS).

The new system is put into use with a new interface, removing the defects of the former online application system with the following features:
  • Drafts can be created for the repetitive works.
  • Uncompleted applications can be saved as drafts for later completing.
  • Electronic notifications will be sent by email and SMS upon the completion of the applications.
  • Attorney information will be fetched automatically.
  • Files can be viewed and filtred by the attorneys.
The system will make it easy for the Turkish patent attorneys and paralegals to handle and administer their applications more smoothly and securely.

TURKPATENT updated the online patent search tool


Turkish Patent and Trademark Office (TURKPATENT) has made a long-awaited update on the patent search and file inspection tool on its website. The update has introduced a new interface and functionalities to the patent search and online file inspection tool.

One of the new features put into service by this update is the possibility to access to the patent documents and files by online. Thus, applicants, patent holders and third parties will be able to inspect the files and documents of the published patent applications and patents by online.

The users will also benefit from detailed search, advanced search, image viewing, and document export functions of the patent search tool.

Use or non-use matter for patents in Turkey


The period for using or working a patented invention is typically three years as from the publication of the patent grant in the Turkish Patent Bulletin or four years as from the application date of the patent, whichever is the later. This period is especially important in respect of the compulsory requests, as it is not possible for third parties to request compulsory license before the expiration of this statuary period.

The due date for use is actually relative since the actual due date for use is calculated considering the date of request for a compulsory license. In other words, the use can be performed any time during the lifetime of the patent but should be performed before the request for compulsory licence for avoiding any risk of compulsory license if three years period have already passed. For instance, if the use has been performed at a time after 3 years as from the publication of the patent grant in the Turkish Patent Bulletin but before the date when the request for compulsory license is filed, the use requirement has been deemed to performed.

In the case of European patents validated in Turkey, the initial 3-years period for the use requirement is calculated based on the publication date of the European patent in the Turkish Patent Bulletin (not the publication date in the European Patent Bulletin). After that period, any third party will be allowed to request compulsory license based on possible non-use.

Whereas the actual use is as defined above, non-use or use declarations, as prescribed by the Implement Regulation (Rule 117 (7)) but not the Law, should be filed within three years as from publication of the decision to grant patent in the Turkish Patent Bulletin or four years as from patent application date, whichever is the later. The use and non-use declarations filed for the patents are published in the Turkish Official Patent Bulletin. The patents in respect of which no use is declared are also published in the Turkish Official Patent Bulletin.

The Implementing Regulation, in general terms, specifies that the market conditions and circumstances beyond the control and will of the patentee is considered in assessing the use. Technical or economic or legal reasons of an objective nature, such as marketing authorization, compliance with standards, need for new applications to be made in different fields are to be deemed to constitute legitimate excuses for the inability to put the patent to use. These reasons in the nature of constituting obstacles for using the patented invention are accepted as reasons beyond the control and will of the patentee.

The Regulation does not prescribe any positive or negative effect on patent rights if use or non-use declaration is not filed within the prescribed due dates. This point is not sufficiently clear but it can be said that the main purpose for requiring to file non-use or use declarations is:
  • to keep the third parties informed of the fact whether the patent is being used or not, on what grounds the use has been or has not been performed, or the legitimate reasons for non-use as generally defined in the Regulation, and
  • to encourage the patent holders to use their inventions or to grant licenses if they do not use their patented inventions directly in Turkey.
As for the nature of the declarations, a standard form (P-34) in the nature of declaration is provided by the Turkish Patent and Trademark Office. The form, to be signed by patent attorney on behalf of the patentee, contains the following statements, one of which is selected:
  • Pursuant to the seventh and eighth paragraphs of Article 117 of the Regulation on the Implementation of Turkish Industrial Property Code (Law No. 6769), it is hereby declared that the invention subject to the application/patent/utility model is used.
  • Pursuant to the seventh and eighth paragraphs of Article 117 of the Regulation on the Implementation of Turkish Industrial Property Code (Law No. 6769), it is hereby declared that the invention subject to the application/patent/utility model is not used.
Although the form provides standard statements, an additional declaration can be submitted along with the form for reasoning non-use or clarifying use. Furthermore, evidences of use in the case of use, and any documents reasoning the non-use in the case of non-use can be attached to the declaration.

The declaration of non-use can cover a legitimate reason as identified above (e.g. procedures of marketing authorization ongoing). On the other hand, the declaration of use can cover a statement how the patented invention is being used in Turkey, e.g. by being imported to Turkey, or being produced in company or facility X located in Turkey etc., which may be useful to discourage third parties who would attempt to request compulsory license.

Alternatively, it is possible to file offer for license to prevent third parties from requesting the compulsory license if the subject invention is not used or will not be put into use by the patent owner. Offer for license can be always withdrawn.

Turkish IP System has become more modern by new amendments



The Implementing Regulation on Industrial Property Code (Reg. No. 30825) has been amended for simplifying the procedures and formalities regarding the rights-cancelling or rights-restricting actions before the Turkish Patent and Trademark Office.

The new amendments came into force after their publication in the Turkish Official Gazette on July 08, 2019 together with a series of amendments which are made in other laws and regulations for reducing the red-tape in the government affairs and simplifying the citizens' business with the government.

After the amendment of the Regulation, the applicants will not be any longer required to submit notarized signature declaration (where the applicant is a natural person) or list of signatures (where the applicant is a legal entity) regarding their actions cancelling, restricting or withdrawing actions regarding their applications, registration or oppositions. Specifically, the notarized signature declaration or notarized list of signatures will not be required for the following actions anymore:
  • Partially renewing a trademark (Reg. Rule 19(ç) (d)).
  • Withdrawing a trademark application (Reg. Rule 22(ç) (d)).
  • Cancelling trademark rights (Reg. Rule 22(ç) (d)).
  • Withdrawing an opposition (Reg. Rule 22(c) (ç)).
  • Cancelling rights for geographical indications (Reg. Rule 46(c)).
  • Withdrawing an opposition regarding an design application (Reg. Rule 66(c) (ç)).
  • Partially renewing a design registration (Reg. Rule 67(c) (ç)).
  • Withdrawing a design application or cancelling a design registration (Reg. Rule 110(2)).
  • Withdrawing a patent application or cancelling patent rights.
In the first version of the Regulation which was put into force on 24 April 2017 after the introduction of the Industrial Property Code on 10 January 2017, many formalities requiring notarization had been already removed.The recent amendments have further modernized the IP system and made it more applicant-friendly.

TURKPATENT has made substantive discounts on search and examination reports

Turkish Patent and Trademark Office (TURKPATENT) has significantly discounted the official fees for search and examination reports in order to reduce patent and utility model registration costs.

The discounted fees will be limited to a certain number of requests for search and examination as follows:

- 10 requests for real persons,
- 25 requests for legal entities,
- 100 requests for universities.

The discounted fee will be 100 Turkish Lira (20 USD).

Thus, for example, if the applicant is a real person, he/she will be able to benefit from discounted fees up to 20 requests, including 10 for the search reports for patent or utility model applications and 10 for the substantive examination reports for patent or utility model applications.

When the number of requests determined according to the type of applicant is exceeded, the normal fees (if the request is filed through the e-government system) will be applied (590 TL (112 USD) for the search report and 355 TL (67 USD) for the examination report).

In the new schedule of official fees set by TURKPATENT for 2019, it has been noted that the official fees for the European patent validations and PCT national phase entries in Turkey have been substantively increased.

TURKPATENT has reduced some of official fees up to 40%

Turkish Patent and Trademark Office (TURKPATENT) reduced some official fees up to 40%. New fees were published on September 05, 2018 in the Turkish Official fees.

The discount covers patent filing fee, patent registration fee, assignment fee, 1 to 10 years patent annuities, trademark filing fee, trademark registration, trademark renewal fee, design filing fee, design renewal fee.

The discount decision has come forward due to extreme depreciation of Turkish lira. The Turkish lira fell up to 20% versus the dollar last month after President Donald Trump said he would double the rates of tariffs on Turkish steel and aluminum.

Reducing the official fees on patents, trademarks and designs, TURKPATENT aims to support the enterprises in their search for protecting their new inventions and brands as well as maintaining their registered ones.

TURKPATENT established a public company for commercialization of the IP rights

Turkish Patent and Trademark Office (TURKPATENT) has established a public company for commercializing the industrial property rights, i.e. patents, utility models, trademarks, designs and geographical signs. The company is named "Turkish Industrial Property Valuation and Consulting Engineering Services Inc. (TÜRKSMD).”

In an interview with Anadolu Agency, the President of TURKPATENT has stated that Turkey has currently 1 million 600 thousand registered industrial property inventory and they are passively staying on the shelves and have not been passed on to the real sector, the established companies will contribute to the transfer to the real sector of the property products.

The objective of TÜRKSMD is to assess industrial property assets of the real and legal entities and ensure commercialization of the patented work growing out of R & D.

Ankara-based Company will provide the following services:

  • Providing venture capital, investment trusts, funds, and joint finance to the start-ups supported by angel investors.
  • Providing valuation and consultancy services in the field of industrial property, training and accreditation activities for institutions, organizations and initiatives, and expertise services in valuing industrial property rights.
  • Preparing feasibility reports for the selection of computer software and hardware for the public, private and legal entities and will provide R & D activities, engineering, consultancy, training, support and service.
  • Providing all kinds of engineering services both in Turkey and abroad. TÜRKSMD will provide engineering services for the creation, development and revision of the intellectual and industrial rights, and will carry out the processes by providing advisory services within the registering and protection of the rights.
  • Providing consulting services to government agencies, legal entities and real persons through the provision of national and international information on commercial and industrial relations, patents, utility models, trademarks, industrial rights, human relations, business administration, marketing, investment, globalization and finance.
  • Conducting researches and preparing reports about the services in foreign countries and will provide consultancy services in the field of software consultancy, patent and trademark valuation services in view of the fields of international law and trade.
In order to realize its aims, TÜRKSMD will establish all kinds of partnerships with domestic and foreign capital companies at home and abroad.

TÜRKSMD will be able to enter the tender in and out of the country and use its rights by establishing facilities, buying, selling, renting businesses, exporting, importing goods and undertaking the projects. The Company will be also able to register and sell these licenses, patents, trademarks, designs and business rights, both directly and indirectly, on behalf of the Company, by the contracts.

Digital Transformation in TURKPATENT

Turkish Patent and Trademark Office (TURKPATENT) has announced that "Digital Archive Project", which was launched in 2015 to transfer approximately 65 million page documents in TURKPATENT's archives to electronic media was completed as from the end of 2017.

In the official announcement, it was mentioned that by scanning the physical archives and transferring them to the electronic medium, the physical movement of the files was minimised, as well as a faster and safer environment for the operations has been provided.

TURKPATENT also stated that e-invoices and e-book applications, where software are completed in line with the goal of realising all internal and external services and transactions in an electronic environment, have been also put into use.

According to the announcement, most of the services of TURKPATENT have been integrated into the e-government gate.

"In order to maintain service quality in view of the increasing workload, the works for the modernisation to establish a modular, expandable and scalable structure to meet the needs in the near future have been made. This will provide high performance, uninterrupted communication with the existing structure that has completed its technological lifetime. In the first months of 2018, the project is planned to be put into life." said TURKPATENT.

Turkish inventions will be exhibited in Geneva

Turkish Patent and Trademark Office is participating in the 46th International Exhibition of  Inventions of Geneva in Switzerland, from April 11th to April 15th, 2018, with three domestic inventors and their inventions. Various 1000 inventions of more than 700 participants from 45 countries will be introduced during the exhibition organized by the World Intellectual Property Organization (WIPO).

The exhibition, attracting the attention of industrialists, investors, businessmen in search of innovation, allows the inventors to introduce their inventions and have financial support for commercializing their inventions. In the exhibition, outstanding inventions are awarded in various categories.

In the last year's exhibition, Turkish inventors:
  • İlter DENİZOĞLU won "Gold" prize and Special Award for Medical Science of Gulian University of Islamic Republic of Iran  and the special award of China's Delegation,
  • Gül Bahar BAŞIM, Sabri Orçun ORHAN, Zeynep ÖZDEMİR, Özkan BEBEK won "Gold" prize and the special award of Ministry of Scientific Research and Innovation of Romania,
  • Ezgi YELEKOĞLU & Altuğ TOPRAK won the "Silver" prize and the special award of China's Delegation.

The following inventions will be exhibited in the boot of the Turkish Patent and Trademark Office during the exhibition of this year.

"Settable Pot" by Arife Sare AYDIN, Inventor

This invention relates to a pot containing a stirrer which is connected to the lid to allow the meal to be stirred at a constant speed while being cooked, and controlled by means of a setting mechanism. Said pot comprises a stirrer which performs the mixing process, a setting mechanism providing movement to the said stirrer, and a lid on which the said components are carried.

"Desktop thermoelectric ice machine" by Raşit AHISKA, Inventor

This invention is an easily portable desktop thermoelectric ice machine which produces ice in a very short time by converting electrical energy from the electric network or battery directly into the cold by means of a thermoelectric module consisting of N and P-type semiconductors without using intermediates. In the designed device, a small amount of clean water is automatically or manually placed in the high-heat-conducting ice container (cooler compartment) to produce ice within 1-3 minutes in a needed amount for cooling a person's drink, and the device is operated with a battery or mains voltage. 30-50 gr of ice, which is the average amount of ice needed to cool a drink in a beverage at one time, is herein produced in 1-3 minutes and can be served automatically or manually. The ice container of the device is cooled by a specially designed single thermoelectric module. Special battery or special SMPS power supply is used to operate the module. A special temperature control circuit is used to keep the device's electricity consumption to a minimum. A heat transfer system having a specially designed heat pipe is used to keep the heating surface of the module at ambient temperature.

Turkish Patent and Trademark Office has released a revised version of its Strategy Document setting out its objectives for the next 5 years.

Turkish Patent and Trademark Office (TURKPATENT) is regularly preparing and releasing strategy documents setting out objectives and goals every five years.

The Strategy Document for five years had been already issued early last year. However, as the Law regarding the establishment and tasks of the Office changed just at the beginning of the last year (on January 10, 2017), it has become a requirement to revise the Strategy Document issued in 2017 in compliance with the new obligations of TURKPATENTbrought by the new Law.

The revised Strategy Document will be implemented between 2018 and 2022 in order to plan and carry out the works during the subject years.

While preparing the Strategy Document, the plans of earlier years, opinions of the stakeholders, the surveys, and workshops have been taken into consideration.

The Document states that TURKPATENT will perform its objectives and take necessary actions in compliance with its mission and vision statements as quoted below:

Mission
Contributing to the effective protection and commercialization of industrial property rights and serving to the economic and technological development of our country by increasing the awareness of industrial property in all layers of the society and being active in international platforms in the field of industrial property.
 Vision
Being an Office contributing to the improvement of Turkey's intellectual capital and innovation capacity and giving direction to national and international policy in industrial property

The Document specifically emphasizes the values of the TURKPATENT, which are reliability, impartiality, customer orientation, quality, effective and fast service, solution-oriented approach, openness to change and innovation, employee oriented approach, openness to cooperating with stakeholders, efficiency in international relations, accessibility, and states that the objectives of the Plan will be realized on the basis of those values adopted by the Office.

Also, the Document makes a comprehensive analysis regarding the current situation, comprising historical developments, laws in force, services currently provided by the Office, the position of the stakeholders, the inner structure of TURKPATENT, and outside conditions affecting the industrial property in Turkey and around the world.

After comprehensively analyzing the current situation and affairs, the Document sets out the objectives, goals and indicators and strategies. It makes 5 objectives as summarized below:
  • Carrying out the services of the industrial property rights qualified, effectively and fastly.
  • Raising the awareness of industrial property rights in the public.
  • Making the industrial property rights into the economic benefits.
  • Actively taking place in the international arena and guiding to the country in the industrial property issues.
  • Making the institutional capacity strengthened.

To realize these five objectives, TURKPATENT is projected to take actions within the scope of 17 goals as summarized below:
  • Increasing customer satisfaction
  • Enhancing the alignment with the judicial decisions
  • Providing all the services electronically

The Strategy Document also makes reference to the 10th Development Plan of Turkey setting out the following objectives.
  • The main objective is to increase the contribution of intellectual property rights and products subject to these rights to the development process, through creating a common and socially adopted system for the use and protection of intellectual property rights.
  • Adequate human and institutional capacity will be created in the relevant units of public sector dealing with protection and enforcement of intellectual property rights, in particular in the judiciary, customs and constabulary.
  • Service capacity will be improved in technology transfer and innovation centres to make businesses benefit effectively from the intellectual property rights system and its subsidies.
  • The effectiveness of existing mechanisms in the commercialization of intellectual property rights will be improved.
  • Public awareness of the intellectual property rights system will be increased by promotional and educational activities at all levels.
  • Identification, monitoring and evaluation of contribution of the works and products subject to intellectual property rights to the national economy will be provided, and information and data infrastructure will be strengthened.

The Document finally sets forth the financial resources to realize the objectives and goals set by TURKPATENT.

To summarize, TURKPATENT aims to improve the capacity and qualification of its human resources, provide all its services electronically and raise public awareness on the intellectual and industrial property issues within next 5 years.

Turkish Patent and Trademark Office has announced its performance goals for 2018.

Turkish Patent and Trademark Office (TURKPATENT) conventionally announces its performance goals and objectives at the beginning of each year. TURKPATENT has released its Performance Document on 11 January 2018.

In the preface of the Document, Chief Executive of TURKPATENT states that the document covers 48 activities which are planned to be performed within the scope of 17 targets which were determined for 5 strategic goals.

The Document covers two main parts, i.e. General Information and Performance Information, each of which is detailed below.

General Information

The Performance Document states the powers, duties and responsibilities of TURKPATENT with an organizational chart (as below) and provides actual details regarding the departmental structure, status of human and physical resources and inventory of TURKPATENT .

The Document reports some important tasks and projects completed in 2017 and projects a series of new tasks and goals in 2018, several of which are summarized below:

  • Technology Infrastructure of the Office has been strengthened in 2017 for shortening the proceedings and decreasing the errors.
  • Integration of the archive of the Office into Electronic Document, Process and Archive Management has continued during 2017 and the completion of the integration is planned in December 2018.
  • Telephone system has been modernized by new technology IP system.
  • The use of Electronic Document Archive Management System (EBAYS) used for internal and external correspondences will be continued in 2018.
  • A new generation data storage unit will be purchased in 2018.
  • Critical data is planned to be kept in a separate data center to avoid any loss of data due to possible natural disasters.
  • Certificate of Management System for Information Security (TS ISO 27001) is aimed to be obtained in 2018.
  • The Office has 470 employees according to data in September 2017.
  • It is planned to employ new patent examiners to increase capacity of the Office for international search and examinations*, new examiners for geographical indications to work in the newly established Division of Geographical Indications, one Legal Consultant for developing laws and regulations, and one lawyer to represent the Office before the Courts during 2018.

Performance Information

The part of Performance Information of the Document refers to the following Fundamental Policies and Priorities for performing the goals and objectives of TURKPATENT in 2018.

  • Turkey's 10th Development Plan (2014-2018), which mainly aims to increase human and institutional capacity of the public sector to protect intellectual property rights, raise service capacity of the technology transfer offices and innovation centers, commercialize intellectual property rights, and raise public awareness on intellectual property right by publicity.
  • Program of 65th Government of Turkey, which projects establishment of Patent Bourse.
  • National Intellectual Property Rights Strategy Paper and Action Plan (2015-2018) of Turkey, which basically aims law and enforcement improvement and effective inspection and protection of intellectual rights, commercialization of intellectual property rights, raising public awareness on intellectual property rights.
  • Geographical Indications Strategy Paper and Action Plan (2015-2018) of Turkey, which mainly aims to develop the laws and regulations for GIs, increase the institutional capacity of the public establishments dealing with the GIs, create an effective inspection system for GIs, develop marketing strategies to increase the added values of the GIs.

  • The alignment between the Office's decisions and the judicial decisions will be enhanced.
  • All services will be provided electronically.

To put it in a nutshell, TURKPATENT is aiming to use the electronic means, promote the knowledge and capacity of human resources and improve infrastructure for high quality and fast services in 2018 and the following years in view of the newly released Strategy Document (2018-2022) covering the activities and actions which are planned between 2018 and 2022.
